1.2. ENTRY, TRANSIT AND DEPARTURE OF AIRCRAFT

1.2.1. General

1.2.1.1. All international flights overlying the airspace of the Republic of Kazakhstan, or landing in its territory, shall be carried out in accordance with current regulations and legislation of Kazakhstan, as listed in AIP section GEN 1.6.

1.2.1.2. These regulations are complemented by international Standards and Recommended Practices contained in Annex 9 to the ICAO Convention, with the differences given in AIP section GEN1.7.

1.2.1.3. International flights/overflights operated by foreign aircraft operators within the territory of the Republic of Kazakhstan can be carried out upon the following requirements:

  1. a) States, airlines must be a party of international agreements for civil air transportation where the Republic of Kazakhstan is a party to;
  2. b) the airline must be eligible to flight operations in accordance with provisions of a bilateral or multilateral agreements between the States of foreign airlines and the Republic of Kazakhstan;
  3. c) aircraft operators must obtain a special permission from the Committee of Civil Aviation of the Republic of Kazakhstan or Ministry of Foreign Affairs of the Republic of Kazakhstan to operate a single or multiple flights.

1.2.1.4. International flights landing or departing from the territory of the Republic of Kazakhstan must execute the first landing and finally depart from an aerodrome where all necessary conditions for customs and immigrations are available.

1.2.1.5. When operating flights by foreign airlines at the airports of the Republic of Kazakhstan the flights can be performed provided that there is a kazakhstan specialist on the aircraft board (a navigator or pilot), exeption - Astana, Almaty, Aktyubinsk, Karaganda and other airports where foreign aircraft operate a regular scheduled flights.

Airports can be used as alternates when they are certified for international operations on a temporary base and published in the AIS Documents.

1.2.2. Application to permission.

1.2.2.1. Any users interested in flight operations within the airspace of the Republic of Kazakhstan shall submit request according to the following terms:

1.2.2.2. Scheduled Flights.

1.2.2.2.1. Application in due 4 (four) copies of "R" form for operation of regular flights by international, CIS and national operators within the airspace of Kazakhstan shall be submitted to the Main Centre of Air Traffic Flow Management (MC ATFM) of Kazakhstan 30 (thirty) days prior commencement of flights and to be adopted by the Committee of Civil Aviation.

1.2.2.2.2. List of documentation to obtain a permission for regular flights performing with landing at the airports of the Republic of Kazakhstan is as following:

  1. Air operator certificate (for international, CIS and national operators).
  2. Operations specification (for CIS and national).
  3. State-license on validation for air transportation (for CIS and national).
  4. Aircraft's registration certificate (for international, CIS and national operators).
  5. Airworthiness certificate (for international, CIS and national operators).
  6. Civil-legal responsibility insurance before third persons and passengers (for international, CIS and national operators).
  7. Aircraft insurance certificate (for CIS and national operators).
  8. Crew insurance licence (for CIS and national operators).
  9. "R" Form duly signed by Head of airline.
  10. Repetitive flight plan (RPL) according to ICAO Doc. 4444.
  11. Slot times coordinated with destinations of the Republic of Kazakhstan.

1.2.2.2.3. List of documentation to obtain a permission for regular transit flights:

  1. Airline operator licence (for international and CIS).
  2. Operations specification (for CIS).
  3. Certificate of aircraft's registration (for CIS).
  4. Airworthiness certificate (for CIS).
  5. Civil-legal responsibility insurance before third persons and passengers (for international and CIS).
  6. Repetitive flight plan (RPL) according to ICAO Doc 4444.

1.2.2.2.4. Any changes to submitted schedule for regular flights shall be addressed to MC ATFM RK in Russian or English 10 (ten) days prior the commencement of flights via the following communication channels:

1.2.2.2.5. All applications are submitted daily, from 0100 until 1300(UTC), except Saturday, Sunday and holidays.

1.2.2.3. Non-scheduled flights

1.2.2.3.1. Application to operate a single charter flight by international operators with landing at airports of Kazakhstan shall be submitted to the Committee of Civil Aviation of Kazakhstan in Russian or English.

1.2.2.3.2. Application to perform a single charter flight by foreign aircraft shall be submitted by operators or an authorized person within the following terms:

  • for a single charter flight - not later than 2 (two) days prior to commencement of flights;
  • for a single charter flight with landing in the airports of the Republic of Kazakhstan - not later than 3 (three) days prior to commencement of flights:
  • for four and more repetitive flights -not later than 3 (three) working days prior to commencement of flights.

1.2.2.3.3. List of documentation to obtain permissions for a single charter flight with landing at airports of the Republic of Kazakhstan:

  1. of ICAO letter on allocation of three-letter name-code (if available) for international and CIS.
  2. Air operator certificate (for international, CIS and national).
  3. Operations specification (for national).
  4. Aircraft registration certificate (for international and CIS).
  5. Airworthiness certificate (for international, CIS and national).
  6. Civil-legal responsibility insurance before third persons and passengers (for international and CIS).

All applications are submitted daily, from 0100 until 1300(UTC), except Saturday, Sunday and holidays.

1.2.2.3.4. Application to operate a transit charter flights by foreign aircraft shall be addressed to Committee of Civil Aviation and MC ATFM RK in Russian or English.

1.2.2.3.5. List of documentation to obtain permissions for transit charter flights:

  1. Copy of ICAO letter on allocation of three-letter name-code (if available).
  2. Air operator certificate.
  3. Aircraft registration certificate
  4. Civil-legal responsibility insurance before third persons and passengers.

1.2.2.3.6 Application for charter flight performing.

1.2.2.3.6.1 Application for charter flight with landing at airports of Kazakhstan should contain the following information:

  1. Name and permanent address of airline.
  2. ICAO designator and flight number.
  3. Aircraft type, a registration number and callsign, State of registry.
  4. Name of pilot-in command, number of crewmembers and their citizenship (main and by-crew).
  5. Category of flight (charter, corporative, ambulance etc).
  6. Passenger/cargo availability and category.
  7. Place of embarkation/disembarkation of passengers and cargo.
  8. Date, entire route and flight schedule (UTC) with indication of airways enroute, entry/exit boundary points to/from the Republic of Kazakhstan.
  9. Consignor (full name, address, phone/fax number).
  10. Consignee (full name, address, phone/fax number).
  11. Type of navigation and communication equipment.
  12. Availability of weapon, ammunition and photo equipment.
  13. Method of payment.
  14. Signature availability, telephone number.

1.2.2.3.6.2 Application for charter transit flight through the airspace of Kazakhstan should contain the following information:

  1. Name and permanent address of airline.
  2. ICAO designator and flight number.
  3. Aircraft type, a registration number and callsign, State of registry.
  4. Category of flight (charter, corporative, ambulance etc).
  5. Passenger/cargo availability and category.
  6. Place of embarkation/disembarkation of passengers and cargo.
  7. Date, entire route and flight schedule (UTC) with indication of airways enroute, entry/exit boundary points to/from the Republic of Kazakhstan.
  8. Type of navigation and communication equipment,
  9. Availability of weapon, ammunition and photo equipment.

1.2.2.3.7. Single flights of foreign aircraft connected with conveyance of head of foreign States and Governments, Ministers of Foreign Affairs and Ministers of Defence, as well as single flights of the State and experimental foreign aircraft are conducted on the basis of permission received via diplomatic channels from the Ministry of Foreign Affairs of the Republic of Kazakhstan.

1.2.2.3.8. Applications are submitted daily from 0100 until 1300 (UTC) except Saturday, Sunday and holidays.

1.2.2.3.9. All applications from 1300 until 0100 (UTC) for urgent flights related with people rescue (ambulance, search and rescue) shall be addressed to Committee of Civil Aviation and MC ATFM RK in English or Russian via the following communication channels:

1.2.2.3.10. Air traffic information (FPL, DEP, ARR, DLA, CNL , etc.) shall be addressed to MC ATFM RK via AFTN communication channel -UAAAZDZX, to FIRs addresses enroute, to ARO of the departure / arrival airports, and for the aerodromes equipped by AS ภาั to the addresses: Almaty - UAAAZAZX, Astana - UACCZAZX.

1.2.3. Documentary requirements for clearance of aircraft

1.2.3.1. Foreign aircraft operators must submit aircraft documents for clearance on entry and departure and from Kazakhstan.

1.2.3.2. All documents must follow the ICAO standard format according to relevant Appendices to ICAO Annex 9 and shall be provided in Russian or English.

1.2.4. Public health measures applied on board of aircraft

1.2.4.1. As the case may be an aircraft has been pronounced by the public health authorities as infected with quarantine disease or if it has arrived from a cholera infected area and carries non-hermetically packed fish, crabs, shellfish, fruit or vegetables eatable uncooked, or beverages, the public health authorities shall have the right to prohibit these from being unloaded or to seize for disinfection or destruction.

1.2.4.2. A standard certificate shall be issued to the pilot-in-command of an aircraft, attesting any medico-sanitary measures on board the aircraft.

1.3. Arrival, transit and departure passengers and crews

1.3.1. General regulations

1.3.1.1. Foreign aircraft, their crews and passengers arriving or departing from the Republic of Kazakhstan and goods exported/imported by the foreign aircraft are subject to passport, customs, monetary, health, quarantine control and other relevant requirements for entry and departure as well as for importation and exportation of property and transit through the territory of the Republic of Kazakhstan.

1.3.2. Immigration Requirements, Passport and Visa Regime

1.3.2.1. Entry and departure of passengers to/from the Republic of Kazakhstan is subject to permission issued by border control points, provided they are in-possession of relevant and valid documents.

1.3.2.2. When entering or leaving the Republic of Kazakhstan every passenger must have a national passport with a valid entry/exit visa, or a document substituting it, unless international agreements to which the Republic of Kazakhstan is a party, stipulates otherwise.

1.3.2.3. In case a foreign aircraft has carried a passenger to Kazakhstan with violation of procedures provided by paras 1.3.2.1 and 1.3.2.2, the operator of the aircraft shall take him back out of the territory of the Republic of Kazakhstan.

1.3.2.4. Transit of passengers through the territory of the Republic of Kazakhstan with one stopover shall be carried out in accordance with the provisions of para 1.3.2.2.

1.3.2.5. Passengers travelling through the territory of Kazakhstan in transit are exempted from the need to hold visas for Kazakhstan in the following cases:

  1. when travelling on a nonstop flight in transit across the territory of the Republic of Kazakhstan;
  2. if in possession of documents giving the right to enter the country of destination and of air tickets with confirmed date of departure from the Kazakhstan airport of transfer within 24 hours;
  3. when being citizens of a State with which the Republic of Kazakhstan has signed appropriate intergovernmental agreements.

1.3.2.6. Disembarkation and/or embarkation of passengers at airports are carried out with the permission of border control points.

1.3.2.7. Arrival in Kazakhstan and/or departure from Kazakhstan of crewmembers of foreign aircraft is effected in accordance with the provisions of para 1.3.2.2. unless international agreements to which the Republic of Kazakhstan is a party, stipulate otherwise.

1.3.3. Customs requirements

1.3.3.1. Baggage, cabin baggage, currency and valuables of passengers and crews carried across Kazakhstan frontier are subject to customs clearance.

1.3.3.2. Passengers arriving in Kazakhstan with cabin baggage and baggage that is not exempted from customs inspection shall complete a customs declaration.

1.3.3.3. Cabin baggage and baggage in possession of passengers, with the exception of articles prohibited from being taken in or out of Kazakhstan, shall be cleared in quantities needed for personal consumption, in accordance with the Rules of Customs Control.

1.3.3.4. Customs inspection of cabin baggage and baggage in possession of passengers arriving in Kazakhstan is carried out in the presence of passengers in clearance rooms, storage and directly in transportation facilities.

1.3.3.5. Hunting guns and ammunition for them as well as fire-arms and ammunition for them and hunting knives, with the consent of the carrier, may be carried as registered baggage, provided that they have been placed in the baggage cargo compartments of the aircraft inaccessible to passengers. In the case guns and/or hand, arms shall be unloaded and ammunition for them packed appropriately separately.

1.3.3.6. Cameras and cinecameras carried on board of aircraft shall be kept in suitcases. Photographing from an aircraft is prohibited.

1.3.3.7. Radio sets, including those of small dimensions, may be carried only if it is packed into baggage.

1.3.3.8. Dropping from aircraft and the use of parachutes in the airspace of Kazakhstan are permitted only in distress. A parachute may be carried on board of an aircraft only if an instruction to this effect is contained in the flight clearance documentation.

1.3.4. Public Health

1.3.4.1. Sanitary-quarantine measures in Kazakhstan are applied in compliance with the requirements of the World Health Organisation.

1.3.4.2. Every passenger arriving in Kazakhstan from quarantine disease infected countries (cholera, plague, and yellow fever) shall present an international Certificate of Vaccination against these diseases.

1.3.4.3. A vaccination certificate is deemed as valid if it is in a form and of terms of validity approved by the World Health Organisation.

1.3.4.4. Any change of the form of a certificate or blankness of one of its items may make the certificate invalid.

1.3.4.5. With regard to passengers not in possession of an international vaccination certificate, the following measures shall be taken:

  • passengers arriving from cholera infected countries not in possession of a valid international vaccination certificate shall be isolated, and arrivals from such countries in possession of a valid certificate shall be medically supervised. The duration of isolation and supervision shall constitute five days from the moment of leaving the cholera-infected country.

1.3.4.6. If a crew-member or passenger falls ill in flight, the pilot-in-command has to report it to ภาั before arriving at an airport so that medical aid is rendered in good time and for providing necessary measures.

1.3.4.7. On arriving at the airport, the pilot-in-command (or his confidential agent) must complete and submit the public health section of the general declaration.

1.3.4.8. In case of a forced landing of an aircraft on international flight at an airport that does not handle international traffic or at a place other than an airport, the pilot-in-command shall take measures preventing the crew and/or passengers from being in contact with the local population. The pilot-in-command shall immediately report to the local authorities on the event.

1.3.4.9. Passengers showing symptoms of acute disease on arriving in Kazakhstan or while staying in Kazakhstan shall be forwarded to the nearest medical institution immediately.

1.3.4.10. Passengers under medical supervision shall enjoy freedom of movement, but shall notify the public health authorities of their moving on to other places.
