GEN 1.2 ENTRY, TRANSIT AND DEPARTURE OF AIRCRAFT
1. GENERAL
1.1 International flights into/from or over territory of the Republic of Lithuania shall be subject to the current regulations relating to civil aviation. In their essentials these regulations correspond to the Standards and Recommended Practices contained in Annex 9 to the Convention on International Civil Aviation.
1.2 Aircraft shall be allowed to cross the border of the Republic of Lithuania by the air routes provided in the airspace structure or the routes specified by the j state enterprise "Oro navigacija" (upon information | the Air Force).
1.3 International flights shall be performed to the airports and aerodromes of the Republic of Lithuania where the customs, border (passport) and other border-crossing procedures are performed (see AIP Lithuania, sections AD 1.3 and AD 2).
1.4 Performing a flight within the airspace of the Republic of Lithuania, aircraft shall be equipped with:
- a radio communication equipment, providing air ground communication;
- a transponder, operating in accordance with requirements of ICAO.
1.5 Flights over the territory of the Republic of Lithuania of the aircraft without the equipment specified in Paragraph 1.4 shall be performed only after coordinating them with the state enterprise "Oro | navigacija" and the Air Force, except for the ' emergency situations during the flight.
1.6 A valid civil liability insurance certificate and other documents stipulated in Article 64 of the Civil Aviation Law, NR Vlll-2066 of the Republic of Lithuania shall be carried by each civil aircraft flying within the airspace of the Republic of Lithuania (see GEN 1.5-3, paragraph 5).
1.7 Aircraft flying to and from the international airports of the Republic of Lithuania, shall conform to the restrictions established in these airports in terms of noise produced by the aircraft.
2. SCHEDULED FLIGHTS
2.1 Procedures
2.1.1 A civil aircraft of foreign states shall be allowed to perform scheduled non-commercial transit flights without landing or with landing in the territory of the Republic of Lithuania requiring no special permission if the aircraft is registered in the state which is a member of ICAO and allows the same free of permission flights of the aircraft of the Republic of Lithuania.
2.1.2 In all other cases, it shall be obligatory to hold a permit issued by the Ministry of Transport.
2.1.3 The permission for the operation of scheduled flights into or out of the territory of the Republic of Lithuania by the operators of foreign states shall be issued by the Ministry of Transport in accordance with the requirements of bilateral agreements. If the Republic of Lithuania has not signed a bilateral agreement on the air transport with the state of the operator, the Ministry of Transport shall be able to issue a provisional permit.
2.1.3.1 Operators performing scheduled flight shall submit a planned flight schedule to the Ministry of Transport not later than 30 days before the beginning of a new season (the beginning of a summer season -last Sunday of March, the beginning of a winter season - last Sunday of October). The same requirements shall be applied when flight schedules are changed.
2.1.3.2 Information on a planned flight deviation from the flight schedule, cancellation of the flight, change of the route and supplementary flights shall be reported to the Ministry of Transport not later than 3 days before the flight, and it shall be obligatory to get a permission from the ministry to introduce this change.
2.1.3.3 Operators performing scheduled air service shall submit passenger and cargo service tariffs and provisions of their application to the Ministry of Transport for approval not later than 30 days before the proposed date of their enforcement.
2.1.3.4 Only approved by the Ministry of Transport tariffs shall be announced.

2.1.4 Foreign state operators, appointed or holding a provisional permit as is provided in the procedure of a bilateral agreement, shall submit the following documents and information to the Ministry of Transport before beginning the operation of scheduled air service:
- a flight schedule;
- proposed air service tariffs and the provisions of their application;'
- data on the types of aircraft used in air service, their capacity, national identification and registration signs;
- civil liability, passenger, baggage and cargo insurance certificates;
- certificates of the noise produced by an operating aircraft.
2.1.5 The Ministry of Transport may request additional documents or information that are not stipulated in item 2.1.4.
2.1.6 In order to perform a scheduled flight by a define route, the operators of the Republic of Lithuania shall obtain the permit from the Ministry of Transport in conformity with the established order.
2.2 Documents required for clearance of aircraft
2.2.1 It is necessary that the under mentioned aircraft documents be submitted by airline operators for clearance on entry and departure of their aircraft to and from the Republic of Lithuania. All documents listed below must follow the ICAO standard format as set forth in the relevant Appendixes to Annex 9 and are acceptable when completed in English or Lithuanian in legible handwriting. No visas are required with such documents.

Note: if no passengers are embarking (disembarking) and no articles are laden (unladen), no aircraft document except copy of the General Declaration need be submitted to the above authorities.
3. NON-SCHEDULED FLIGHTS (CHARTER FLIGHTS)
3.1 Procedures
3.1.1 Permission for a non-scheduled transit flight without or with landing for non-commercial purposes in the territory of the Republic of Lithuania shall not be required if it is performed by aircraft registered in the state which is a member of the ICAO and allows the same free of permission flights for aircraft of the Republic of Lithuania.
3.1.2 Commercial flights with landing in the Republic of Lithuania require a permit of the Ministry of Transport. The permit is valid only for the number of flights and time indicated therein. The permit cannot be extended.
3.1.3 An application to obtain the permit shall be submitted by an operator who practically operates an aircraft or by a person authorized by the operator.
3.1.4 A permit may be issued for:
- one flight;
- a line of flights consisting of not more than 4 flights;
- a line of flights consisting of more than 4 flights.
3.1.5 A written application to perform flights specified in Paragraphs 3.1.4 a) and 3.1.4 b) shall be submitted to the Ministry of Transport not later than 2 workdays before the day of the flight and to perform the flights specified in Paragraph 3.1.4 ñ) - not later than 5 workdays before the day of the flight.
3.1.6 An application shall contain:
- name and address of an operator, name and address of a person authorized, telephone and fax numbers;
- type, national identification and register signs of an aircraft;
- flight number;
- charter type;
- number of passengers, amount and type of cargo;
- name and address of a flight charterer; name and address of a person authorized, telephone and fax numbers;
- entire route of the flight;
- total schedule of the flight.
3.1.7 The Ministry of Transport may request additional information if needed.
3.1.8 An application shall be put in writing in Lithuanian or English.
3.1.9 A permit shall be issued to a foreign country aircraft to perform a non-scheduled commercial flight into the Republic of Lithuania provided the state, where the aircraft concerned is registered, allows the same flights to an aircraft of the Republic of Lithuania into its territory.
3.1.10 The Ministry of Transport shall have the right to establish certain requirements and restrictions and refuse to issue a permit for a non-scheduled flight under the following conditions:
- if the flight mentioned herein may cause damage to the scheduled air service of the operators of the Republic of Lithuania;
- if the flight between the Republic of Lithuania and a foreign country is performed by an aircraft of the third state;
- if the application does not contain all necessary data and information;
- if misleading or erroneous data were provided in the application.
3.1.11 The aircraft flight permit shall be valid for 4 hours before planned departure time and 48 hours after the planned departure time.
3.2 Documents required for clearance of aircraft: same requirements as for SCHEDULED FLIGHTS.
4. NON-COMMERCIAL FLIGHTS
No special permission is needed for non-commercial flights of a foreign country aircraft into and out of the territory of the Republic of Lithuania. The present Regulations shall not be applied to the state aircraft of a foreign country.
5. PRIVATE FLIGHTS
5.1 Advanced notification of arrival
5.1.1 The information contained in the flight plan is accepted as adequate advance notification of the arrival of incoming aircraft.
5.2 Documents required for clearance of aircraft
Same requirements as for SCHEDULED FLIGHTS.
6. STATE AIRCRAFT FLIGHTS
6.1 Procedures
6.1.1 Flights of the state aircraft of foreign countries into, out or over the territory of the Republic of Lithuania shall be performed only upon the permission.
6.1.2 Permits for the flights of state aircraft of foreign countries shall be issued by the Ministry of Foreign Affairs upon recommendation of the Ministry of Defence. In urgent cases a permit shall be issued by the Ministry of Defence which shall thereon inform the Ministry of Foreign Affairs and other institutions, if needed.
6.1.3 The application for the permit shall be submitted to the Ministry of Foreign Affairs through the embassy of the foreign state or the Republic of Lithuania not later than 5 workdays before the flight.

6.1.4 An application to obtain a permit shall contain the following data:
- the state wherein an aircraft is registered;
- type of aircraft, maximum take-off mass (MTOM);
- registration sign of aircraft;
- radio call sign;
- flight number, if allotted;
- name and surname of an aircraft commander (as well as the commander's military rank, in case of an air force aircraft) and number of the crew members;
- destination aerodrome and the flight route;
- purpose of the flight;
- border crossing areas of the Republic of Lithuania (when flying into and out of the state) and estimated time of border-crossing (when flying into and out of the state);
- provided an aircraft lands in an aerodrome of the Republic of Lithuania - name of the aerodrome, landing date, estimated time of landing and departure, necessary services and procedures for their provision;
- number of passengers and names, surnames, posts and ranks of VIPs, if there are any among the passengers;
- cargo declaration, if hazardous materials are conveyed - their names, hazard class in accordance with the classification of ICAO, the amount of hazardous material. In case military material of explosives are conveyed - their name and amount (an emergency card must accompany the application for the permission to convey the explosives);
- information on photo, film and visual aid equipment;
- information on the armament, if there is any on board the aircraft.
6.1.5 The Ministry of Defence shall establish the order of submission of applications for permits for foreign aircraft flights into, out or over the territory of the Republic of Lithuania, as well as the order and terms of issuance of permissions upon coordination with the Ministry of Foreign Affairs.
6.1.6 The civil aircraft flight permit shall be valid for 4 hours before the planned departure time and 48 hours after planned departure time. The present provision shall be binding on the state aircraft of foreign countries, conveying VIPs.
GEN 1.3 ENTRY, TRANSIT AND DEPARTURE OF PASSENGERS AND CREW
1. CUSTOMS REQUIREMENTS
1.1 Passengers and crew arriving in or departing from the Republic of Lithuania shall declare the things (goods) carried therewith according to the procedure established by the Customs Department. The declaration is made either in a written or oral form, or by choosing the red or green channel (in the case of a dual-channel system).
1.1.1 In applying this system passengers and crew are allowed to choose one of the two channels -green or red.
- Upon choosing the green channel, a passenger declares that he/she does not carry things in quantities or values exceeding those admissible duty-free import (export) quantities on which fixed import (export) duties and taxes are imposed or which are subject to importation (exportation) prohibitions and restrictions.
- The red channel is not to be chosen when, in cases specified, it is allowed to transport things in guantities exceeding those admissible duty-free import (export) quantities on which importation (exportation) duties and taxes are imposed or which are subject to importation (exportation) prohibitions and restrictions.
1.1.2 Passengers and crew choosing the green channel are not subject to any additional customs control (except passengers who are cleared at random).
1.2 When needed, the customs has the right to subject all travellers to a thorough customs control. Upon a request of the customs official, a passenger shall unpack all the luggage carried and present things (goods) for the customs control.
1.3 A passenger is subject to a body search in exceptional cases only, under the permission of the Head of the Customs or his/her deputy, providing there is a reason to suspect that a passenger is smuggling, committing some other offense or violating the administrative order.
1.4 Transit passengers who do not leave the territory of the transit zone in international airports are not subject to customs control.
1.5 In case a passenger refuses to pay import duties, taxes or a deposit or to present a security, and refuses his/her goods, also, in case he/she caries things (goods) illegally, things (goods) are detained and confiscated, and a passenger is called to be liable in the order established by the Laws of the Republic of Lithuania.
2. IMMIGRATION REQUIREMENTS
2.1 A border police officer is obligated to demand from the passenger to produce a passport or any other equivalent document, and other documents needed for the check; a crew member has to produce a passport or a crew member certificate corresponding to International Civil Aviation Convention signed on December 7, 1944 in Chicago and other documents needed for the check.
2.2 A person entering or departing the Republic of Lithuania must hold a valid "passport.
2.3 No documents or visas are required of passengers arriving and departing on the same through flight or transferring to another flight at the same airport.
2.4 A person entering the Republic of Lithuania must hold a visa. No visa is required from the citizens of Australia, Austria, Belgium, Bulgaria, Canada, Cyprus, the Czech Republic, Denmark, Estonia, Finland, France, Germany, Great Britain, Greece, Hungary, Iceland, Ireland, Italy, Japan, Korea, Croatia, Latvia, Liechtenstein, Luxembourg, Malta, the Netherlands, New Zealand, Norway, Poland, Portugal, the Slovak Republic, Slovenia, Spain, Sweden, Switzerland, the USA, the Vatican and Venezuela.
2.5 No visas are required from the citizens of Andorra, Israel, Monaco, San Marino, South Africa, if they hold an Estonian or Latvian visa.
2.6 Transit passengers must hold a transit visa.
2.7 All passengers have to obtain a Lithuanian visa prior to the visit to the Republic of Lithuania. An entrance visa to the Republic of Lithuania shall be issued by a diplomatic or consular mission located abroad.
2.8 The passengers arriving from a foreign State by aircraft into the territory of the Republic of Lithuania must pass the passport control. The same procedure is applicable to aircraft crew members, if they are departing from the airport.
3. PUBLIC HEALTH REQUIREMENTS
3.1 A passenger on his arrival to the Republic of Lithuania must have his health checked as to dangerous and very dangerous contagious diseases if he is supposed to have arrived from the area that is contaminated by very dangerous contagious disease viruses or bacteria in the incubation period or has contacted such a disease.
3.2 On the arrival in the Republic of Lithuania passengers and crew members must undergo and medical quarantine check first, since border and customs control is carried out only after the medical check is finished and after medical anti-epidemic precaution measures have been taken, if need be.
3.3 The Ministry of Health Care compiles a list of the countries for which the citizens of Lithuania must be vaccinated prior to their departure.
