GEN 1.2 ENTRY, TRANSIT AND DEPARTURE OF AIRCRAFT

1. General

1.1. International flights into, from and over Moldovan territory shall be subject to the current Moldovan regulations relating to civil aviation.

1.2. Aircraft flying into or departing from Moldovan territory shall make their first landing at, or final departure from, an international aerodrome (see AEP Moldova, AD 1.3, AD 2>.

In case of force majeure or any other justified reasons, the customs, immigration control as well as medical and phitosanitary control shall be completed at the take-off71anding points or in any other way, depending on circumstances. The air operator shall bear the expenses resulted from such special organised controls.

2. Scheduled flights

2.1. Procedures

2.1.1. General

For regular international scheduled flights operated by foreign airlines into Moldova, the airline concerned must be eligible to make the flights under the provision of a bilateral or multilateral air services agreement to which the State of the airline and the Republic of Moldova are contracting parties and must have a permit to operate in the Republic of Moldova. Applications for such permits shall be submitted within the period specified in such agreements to:

2.1.2. Conditions for admission of the application for issuance of the Operating Authorization

The applicant for the Operating Authorization has to fulfill the following requirements:

  1. to be a physical or a juridical person registered in a foreign state,
  2. to be a holder of a valid AOC issued by the aviation authority of the state of registration of the air operator.

2.1.3. The application for the authorization

The application for the issuance of the Operating Authorization shall be filed with the CAA in written form.

2.1.4. The content of the application

The application for issuance of the Operating Authorization shall comprise the following information:

  1. name and address of the air operator;
  2. itinerary;
  3. information concerning the designation of the air operator (if applicable);
  4. flights' frequency;
  5. the estimated date for beginning of operation of the route;
  6. schedule of flights;
  7. tariffs to be applied.

2.1.5. In-line documentation

2.1.5.1. In case of issuing the Operating Authorization according to the provisions of a signed Air Services Agreement, the following documentation shall be attached to the application additionally:

  1. the copy of the official designation issued by the state of the air operator, according to the provisions of the Air Services Agreement;
  2. the copy of the Air Operator Certificate;
  3. the aviation security program, approved by the aviation authority of the state of origin of the air operator;
  4. copies of the insurance certificates covering passengers and third party liabilities;
  5. the list of the aircraft which are to be operated, indicating the capacity, registration marks and the owner of these aircraft;
  6. copies of the registration certificates of the aircraft which are to be operated;
  7. copies of the airworthiness certificates of the aircraft which are to be operated;
  8. the copy of the lease agreement/joint operation of the aircraft, if necessary.

2.1.5.2. In case of issuing the Operating Authorization, before the Air Services Agreement is signed, the following documentation shall be attached to the application additionally:

  1. the copy of the Air Operator Certificate;
  2. the aviation security program, approved by the aviation authority of the state of origin of the air operator;
  3. the copies of the insurance certificate covering passengers, baggage, goods and third parties liabilities;
  4. the list of the aircraft which are to be operated, indicating the capacity, registration marks and the owner of these aircraft;
  5. copies of the registration certificates of the aircraft which are to be operated;
  6. copies of the airworthiness certificates of the aircraft which are to be operated;
  7. the copy of the lease agreement / joint operation of the aircraft, if necessary;
  8. the copy of the document which confirms the agreement of the national air carrier operating scheduled flights on the requested air route regarding the applied tariffs and flights frequency;
  9. declaration of competence.

2.1.6. Terms

2.1.6.1. The initial application for issuance of the Operating Authorization shall be submitted to the CAA at least 30 days before the estimated date of starting the operation of air services on the requested route.

2.1.6.2. The application for prolongation of the Operating Authorization of the air operators that are not designated on the basis of an Air Services Agreement shall be submitted at least 20 days before the date of beginning of a new IATA season.

2.1.6.3. The airlines designated on the basis of an Air Services Agreement shall submit to the CAA the flight schedule for approval, at least 10 days before the date of beginning of a new IATA season.

2.1.7. The registration of the application

When the application is received, the CAA shall register all in-line documents submitted by the applicant, m case the received documentation is incomplete, the application is considered as been received on the date the last necessary document was submitted.

If, during 15 working days, since the application has been submitted, there was not-submitted the whole set of documents, the CAA shall return back the applicant the presented documents, without examining.

2.1.8. The content of the Operating Authorization

  1. The Operating Authorization for scheduled flights shall contain the following:
  2. name of the air operator;
  3. the route;
  4. the operation conditions established for the route;
  5. the validity (if applicable);
  6. the flight schedule, indicating the type of the operated aircraft.

2.1.9. Issuance and validity of the Operating Authorization

2.1.9.1. The Operating Authorization granted on the basis of an Air Services Agreement is valid for the period of action of the bilateral Agreement and in other cases, the Operating Authorization is valid for a period of three months up till a year, at the decision of the CAA.

2.1.9.2. The CAA shall issue the Operating Authorization within 30 days since the last necessary document, mentioned in Para 2.1.5. was registered.

2.1.9.3. The Director General of the CAA signs the Operating Authorization. 2.1.10. The activity after the Operating Authorization is issued

2.1.10.1. The Operating Authorization issued by the CAA is transmitted to the applicant. The copy of the Operating Authorization is kept within the CAA.

2.1.10.2. After the Operating Authorization is issued, the air operator may at any time begin the operation of the route specified in Authorization, respecting the established conditions for operation.

2.1.11. Suspension and revocation of the Operating Authorization

2.1.11.1. The Director general decides, upon the suspension or revocation of the Operating Authorization. The Operating Authorization may be suspended or revoked in cases when:

  1. the legislation of the Republic of Moldova is not respected;
  2. the requirements and conditions of authorization are not respected;
  3. the provisions of the bilateral aeronautical agreement are not respected (if applicable);
  4. the non-authorized flights are executed;
  5. there are debts with expired terms towards the airport and/or the ATS unit of the Republic of Moldova.

2.1.11.2. In case when there are grounds for suspension of the Operating Authorization, the CAA shall warn, in written form, the air operator about the committed violations;

2.1.11.3. The air operator is obliged to eliminate the violations found out, during a term of 10 days since he was warned. Otherwise, the CAA suspends the Operating Authorization.

2.1.11.4. In special cases, the CAA may suspend immediately the Operating Authorization as to avoid new violations of the legislation in force of the Republic of Moldova.

2.1.11.5. It is prohibited to operate the route in the situation when the Operating Authorization is suspended, and it leads to an immediate revocation of the mentioned authorization.

2.1.11.6. The decision regarding the suspension or revocation of the Operating Authorization is communicated in written form, by the CAA to the air operator in question and at the same time to the aviation authority of the state of origin of the air operator.

2.1.11.7. In case an Operating Authorization is revoked, the procedure of certification shall be resumed and shall be performed as in the case of the initial certification procedure.

2.1.12. Complaints

2.1.12.1. The decision regarding the refusal to issue, suspend or revoke the Operating Authorization, together with motives that stood at its basis are communicated in written form to the applicant/air operator and aviation authority of the state of origin of the air operator.

2.1.12.2. The examination of the complaints regarding the refusal decision to suspend or revoke the Operating Authorization is performed in accordance with the legislation in force of the Republic of Moldova.

2.1.13. Insurance level of the passengers and third parties liability

2.1.13.1. The insurance level for death, bodily or mental injury suffered by a passenger as a result of an accident shall constitute at least 250 000 SDR per passenger.

2.1.13.2. The insurance level for the damages brought to third parties as a result of an accident shall correspond to the following minimal levels;

2.2. Documentary requirements for clearance of aircraft

2.2.1. It is necessary that the under mentioned aircraft documents be submitted by airline operators for clearance on entry and departure of their aircraft to and from Moldova. All documents listed below must follow the ICAO standard format as set forth in the relevant appendices to ICAO Annex 9 and are acceptable when furnished in English, Romanian or Russian and completed in legible handwriting. No visas are required in connection with such documents.

2.2.2. Aircraft documents required (arrival/departure):

* - General declaration is required for foreign aircraft; the list of an established form of the members of the crews is required instead of general declaration for aircraft of the Republic of Moldova.

Note: One copy of the General Declaration is endorsed and returned by Customs, signifying clearance.

3. Non-scheduled flights

3.1. Procedures

3.1.1. Conditions regarding the admission of the application for issuance of non-scheduled flights Authorization

3.1.1.1. The civil aircraft performing international non-scheduled flights into or departing from Moldovan territory, shall make their first landing at or final departure from an international airport, except the cases when these are authorized otherwise by the CAA of the Republic of Moldova or in caseofforce-majeure.

In such cases the customs, the frontier, the sanitary and phytosanitary control shall be completed at the take-off/landing points or in any other way, depending on circumstances.

3.1.1.2. In case of a series of three or more consecutive flights during thirty days on the route operated by a designated airline of the Republic of Moldova, before the flights are permitted, there shall be requested an agreement of the said designated airline.

3.1.2. The application for Authorization of the non-scheduled flights

The application for Authorization of a non-scheduled flight shall be filed in written form with the CAA m the conditions established by the present regulations. The CAA address, to which the application for Authorization of a non-scheduled flight shall be handed in, is published in para 2.1.1.

3.1.3. Flight plan

The flight plan shall be submitted, in written form, to the authorized ATS unit of the Republic of Moldova.

3.1.4. Terms

3.1.4.1.The application for Authorization of non-scheduled flights must reach the CAA at least 2 full working days prior to the beginning of the flight. The application shall be submitted to the authorized ATS unit of the Republic of Moldova simultaneously.

3.1.4.2.The application for Authorization of the "taxi-class", business and private flights shall be submitted to the CAA at least 6 hours before take-off. The application shall be submitted J;o the authorized ATS unit of the Republic of Moldova simultaneously. ' '*'"

3.1.4.3. The flight plan shall be filed with the authorized ATS unit of the Republic of Moldova at least 2 hours before take-off.

3.1.4.4.If an air operator intends to perform a series of flights with landing on the territory of the Republic of Moldova, the air operator must submit the application to the CAA at least 10 working days prior to the beginning of the first flight from a series of flights.

3.1.4.5. Application to operate 5th freedom flight must reach the CAA at least 3 full working day prior the beginning of the flight. The application shall be submitted to the authorized ATS unit of the Republic of Moldova simultaneously.

3.1.5. The content of the application for issuance of the Flight Authorization

The application for Authorization should include the following information:

  • name and address of the operator;
  • itinerary of the flight;
  • flight number;
  • type of aircraft, registration marks and MTOW;
  • points of entrance and exit from FIR of the Republic of Moldova;
  • the estimated flight schedule (UTC);
  • purpose of flight, number of passengers and/or nature and amount of freight;
  • presence of the necessary authorizations for flight performance;
  • name, address and business of charterer (if applicable);
  • transport destination;
  • copy of the insurance policies covering passengers and third parties liability.

Additionally, for the series of/lights, to the application shall be attached:

  • the estimated date and time for landing/take-off from the territory of Republic of Moldova;
  • name and address of freighter;
  • the agreement with travel agency(ies) or tour organizers), in case of passenger transportation;
  • the charter contract, in case of cargo flights.

The CAA reserves the right to request any other additional information, which it considers necessary.

3.1.6. Issuance/refusal to issue the Flight Authorization

3.1.6.1. The CAA issues the Flight Authorization, after the examination of the information comprised in the application. The flight shall be operated if the CAA has issued the Flight Authorization, only. The CAA transmits the Flight Authorization to the applicant with the copy to the authorized ATS unit of the Republic of Moldova.

3.1.6.2. The Deputy Director General of the CAA shall sign the Flight Authorization but in his absence the Head of the International Relations Division of the CAA shall sign it.

3.1.6.3. The refusal to issue the Flight Authorization is communicated, in written form, to the applicant with motives that stood at its basis.

3.1.7. The content of the Flight Authorization

The flight Authorization comprises the following elements:

  • date of issue;
  • the name of air operator;
  • type of aircraft and registration marks;
  • number of the Authorization;
  • date of operation;
  • number of the flight;
  • itinerary;
  • conditions for operation;
  • validity period, in case of a flight delay.

3.2. Series of flights

In case of a series of flights, the air operator shall fulfil the following -conditions in order to obtain an Authorization:

  • the flights shall not be published in the computerized reservation systems (CRS);
  • the duration of the flight series shall not exceed a period of six months, and in case of seasonal flights - the respective IATA season.

3.3. "Taxi-class", business and private nights

3.3.1. The application for "Taxi-class", business and private flights shall be filed with the CAA, in terms mentioned in para 2.1.8.

3.3.2. The application for "Taxi-class", business and private flight authorization shall comprise the information mentioned in para 3.1.5.

3.3.3. Prior Authorization is not obligatory for "Taxi-class" and business flights provided that the seating capacity does not exceed ten seats and provided that the destination is chosen by the hirer or hirers and no part of the capacity of the aircraft is resold to the public.

3.3.4. The flight plan shall be submitted to the certified ATS unit of the Republic of Moldova, in terms mentioned in para 3.1.4.

3.4. Non-commercial flights

3.4.1. Prior Authorization is not obligatory for private flights operated by aircraft registered in States, which are parties to the Chicago Convention overflying the territory of the Republic of Moldova or for making non-traffic stops on the territory of the Republic of Moldova.

3.4.2. A flight plan submitted to the certified ATS unit of the Republic of Moldova, according to the terms mentioned in para 3.1.4. is accepted as an adequate notification for private flights performed by aircraft registered in States, which are parties to the Chicago Convention overflying the territory of the Republic of Moldova or for making non-traffic stops on the territory of the Republic of Moldova.

3.4.3. A flight plan submitted to the certified ATS unit of the Republic of Moldova 10 minutes in advance before departure is accepted as an adequate notification for air operators performing emergency, ambulance and search and rescue flights to and from the territory of the Republic of Moldova.

3.5. Dangerous goods

In case an aircraft transports dangerous goods over the territory or with technical stop on the territory of the Republic of Moldova, the application shall be submitted to the CAA in terms indicated in para 3.1.4.

The application shall contain the information indicated in para 3.1.5.

3.6. Transportation of Weapons

In case an aircraft transports weapons over the territory or with technical stopover on the territory of the Republic of Moldova, the application must be submitted to the Ministry of Foreign Affairs of the Republic of Moldova at least 5 days before departure.

The application shall include the information contained in para 3.5.

3.7. Flights of state aircraft and of the aircraft carrying official delegations hi case state aircraft or aircraft carrying official delegations performing flights into or in transit over the territory of the Republic of Moldova, the applications must be submitted to the Ministry of Foreign Affairs of the Republic of Moldova in terms indicated in para 3.1.4.

The application shall contain the information contained in para 3.1.5.

3.8. 5th freedom nights

In accordance with me Article 5 of Convention on International Civil Aviation, the Republic of Moldova, as a rule, does not issue Authorizations to operate 5th freedom flights.

However, on exceptional basis, the Authorization to îðåãà1å5* freedom flights can be granted for special cases and in conditions determined by the CAA of the Republic of Moldova.

3.9. The insurance level of the passengers and third parties liability

The insurance level for death, bodily or mental injury suffered by a passenger as a result of an accident shall constitute at least 250 000 SDR per passenger.

The insurance level for the damages brought to third parties as a result of an accident shall constitute the following minimum levels:

3.10. Documentary requirements for clearance of aircraft

Same requirements as for SCHEDULED FLIGHTS.

4. Public health measures applied to aircraft

4.1. No public health measures are required to be carried out in respect of aircraft entering Moldova.

4.2. In case of obtaining the information about availability on an aircraft of the patient with symptoms ofzygotic disease, mosquitoes and mice - on arrival in destination the aircraft is subjected to sanitary examination. On medical sanitary measures, conducted on an aircraft, to a commander of aircraft is granted the certificate of an established form.

5. Airport Slot coordination

5.1 General

  1. In order to ensure a harmonized, efficient using of airport capacity, at the International Airport Chisinau the departure and arrival times of all planned scheduled/non-scheduled flight operations shall be previously agreed with Airport Schedule Coordinator.
  2. Airline operators submit RPL/FPL to ÀÒÑ after slot confirmation by Schedule Coordinator has been granted only.
  3. Confirmation of a slot by Schedule Coordinator does not exempt from:
    • authorization of Traffic Rights;
    • filling the FPL;
    • an ATFM slot allocation if appropriate.
  4. the request for the airport slot shall be prior to the filling of the flight plan, which must include the estimated off-block time (EOBT) based on the above mentioned authorized airport slot.

Office hours

AIRPORT SLOT - it is scheduled time of arrival (Estimated Time of arrival/ETA) or departure (Estimated Time of Departure/ETD) available or allocated to an aircraft on a specific date at a specific airport. The assignation of an "AIRPORT SLOT" does not represent a right of ownership, but just a clearance of operation subject to control by the Schedule Coordinator on behalf of airport authorities.

SUMMER SEASON - Period of time comprised between the last Sunday of March and the Saturday before the last Sunday of October.

WINTER SEASON - Period of time, comprised between the last Sunday of October and the Saturday before the last Sunday of March.

5.2 Procedures

The following procedures are applicable to all commercial, both of passengers and of cargo flights, that are operated at International Airport Chisinau.

5.2.1 Scheduled and scheduled charter flights

The application for the airport slot confirmation both for scheduled and scheduled charter flights (series of charter flights) shall compulsory be filled out in accordance to the instructions specified on the "Standard Schedule Information Manual (SSIM)" of IATA. The application for the airport slot coordination shall comprise the following information:

  • Name and IATA three-letter code of the air operator;
  • Airport of departure;
  • Airport of arrival;
  • Period of flight operation;
  • Time of departure/arrival from/to all the airports en-route;
  • Type and version of the aircraft;
  • Type of flight service (SSIM IATA, Appendix Ñ "Services Types").

Requests for airport slot coordination will preferably be sent via SITA network; if unable, AFTN, mail, fax.

Requests for any of flight changes, AD-HOC schedule will be sent to the Schedule Coordinator in accordance to the instructions specified on the SSIM of IATA but at least 7 (seven) days before the start day of AD-HOC or schedule change.

Requests for temporary, no repetitive schedule changes applying the time of arrival/departure to/from International Airport Chisinau will be sent to the Schedule Coordinator at least 1 (one) day before the coming them into force.

5.2.2 Non-scheduled commercial flights

The application for the airport slot confirmation for non scheduled commercial and series of non-scheduled commercial flights shall compulsory be filled out in accordance to the instructions specified on the "Standard Schedule Information Manual (SSIM)" of IATA.

The application will be sent to the Schedule Coordinator at least 2 (two) business days prior the date of flight operation.

5.3 Exemptions

Flights that do not require scheduling coordination are listed hereunder:

  • Flights "taxi-class", business, private, non-revenue
  • Flights rerouted to an alternate aerodrome due to technical or meteorological reasons;
  • Flights meeting humanitarian reasons;
  • Flights on search and rescue missions;
  • State aircraft flights;
  • Other flights exempted by the CAA of Moldova.

GEN 13 ENTRY, TRANSIT AND DEPARTURE OF PASSENGERS AND CREW

1. Customs requirements

1.1 The natural persons are obliged to declare orally or in writing material values imported and removed beyond the Republic of Moldova limits and also to present them to the customs. Below listed goods are subjected of the mandatory written customs declaration:

  • Weapons, ammunition, explosive and radioactive substances
  • Products and narcotic of means substances, and also toxic substances and appliances for their use;
  • Antique and art objects;
  • National currency of the Republic of Moldova, bond of the state loans of the Republic of Moldova, ticket of national lotteries, and also checks of National Bank of Moldova;
  • Other currency, payment documents and share values;
  • Precious metals and stones of any kind.

1.2 The importation of a foreign currency is unlimited.

1.3 Exportation from country of a foreign currency:

Visitors of the Republic of Moldova for exportation of a foreign currency are obliged to present the following documents:

  • Customs declaration verifying importation of a foreign currency in the Republic of Moldova;
  • Sanction, given by authorised Bank for exportation of a foreign currency beyond country limits.

1.4 The natural persons, which import and remove values on customs territory are obliged to pay all customs duties pursuant to the customs schedule, to observe rules of economic policy (quota, the license etc.), and also to execute the established requirements of the customs legislation.

2. Immigration requirements

2.1 No documents or visas arc required of passengers arriving and departing on the same through flight or transferring to another flight at the same or a nearby airport.

2.2 A person coming into the Republic of Moldova must hold a valid passport and an entry visa.

2.3 The foreign citizens of those countries, with which the Republic of Moldova has not signed the mutual agreements concerning entry without visa mode, can receive the entry / exit visas on the basis of invitation from legal and as well as natural persons, citizens of the Republic of Moldova.

2.4 The entry / exit visas to the Republic of Moldova can be received at Moldovan Embassies and Consulates abroad, and as well as at consular posts existing at control points for crossing the state border: "Chisinau Aeroport" "Leuseni", "Cahul".

2.5 The citizens of the states - members ofEU, and also the USA and Canada, can receive the entry / exit visas for a term of up to 90 days without the invitations. For citizens of Romania and CIS countries, except Turkmenistan, come to the Republic of Moldova visas are not requited. The citizens of Poland, Hungary, Czech Republic, Vietnam, Cuba, Mongolia and Northern Korea can come to the Republic of Moldova without visas but on the basis of invitation. The citizens of China, Iran, Turkey and Israel, holders of the diplomatic and official passports, and as well as citizens of EU, USA and Canada, holders of the diplomatic passports, can come and stay on the territory of the Republic of Moldova without the visas for a period of up to 90 days.

2.6 General requirements are applied for flight crewmembers.

2.7 No departure formalities are required for embarking passengers.

3. Public health requirements

3.1 Passengers disembarking into the Moldovan territory are required to present valid vaccination international certificates, according to the terms and conditions set forth in the World Health Organisation publications concerning the vaccination certificates required for -international journeys. Passengers and crewmembers may also be requested to file a form-questionnaire, necessary for the antipaludal protection of the Moldovan territory.

3.2 In addition to the provisions contained in paragraph 3.1, all provisions of the International Health Regulation relative to crewmembers, passengers, freight and aircraft are also compulsory.
