1.2. ENTRY, TRANSIT AND DEPARTURE OF AIRCRAFT

1.2.1. General

1.2.1.1. All international flights operated into, from or over territory of Ukraine shall be subject to the current Ukrainian regulations as listed in section GEN 1.6 .

Those regulations reflect in all essentials the Standards and Recommended Practices contained in Annex 9 to the ICAO Convention, with the differences given in AIP section GEN 1.7 .

1.2.1.2. All aircraft operating international flights into or departing from the territory of Ukraine must have first landing at or final departure from an international aerodrome (see AD 1.3) where custom , immigration, quarantine and border services are available.

1.2.1.3. Flights of foreign airlines to other aerodromes within Ukraine must be operated carrying on board Ukrainian navigator (see G 4.1.6). [0207]

1.2.2. Scheduled flights

1.2.2.1. General

1.2.2.1.1. Regular international flights operated by foreign operators into Ukraine or accomplishing operational stop in Ukraine may be carried out if the following requirements are met.

  • the state of the airline must be party of international treaties on civil aviation transportation to which the Ukraine is party;
  • the airline must be eligible to make the flights under provisions of a bilateral or multilateral agreement to which the state of the foreign airline and Ukraine are parties.
  • the aircraft operator obtained a special landing permission of State Department of Aviation Transport of Ukraine (Ukraviatrans) to operate a single or multiple flights.

1.2.2.2. Documentary Requirements for Clearance of Aircraft

1.2.2.2.1. Foreign aircraft operators must submit aircraft documents for clearance on entry and departure to and from Ukraine according provisions contained in 1.2.2.3.4.

All documents must follow the ICAO standard format as set forth in the relevant Appendices to ICAO Annex 9 and shall be provided in Ukrainian, English and/or Russian. No visas are required in connection with such documents.

The General Declaration is required in 4 copies. Custom returns one approved copy that certify custom clearance.

1.2.2.3. Procedure to obtain the permission for carrying out scheduled flights

1.2.2.3.1. The permission to operate scheduled flight within the Ukrainian territories can be obtained upon submission of an application, not later than 30 days before the beginning of flights.

1.2.2.3.2. This application should include:

  • period of flights;
  • three-letter ICAO designator;
  • flight number;
  • routing;
  • type of flight (passenger, cargo);
  • type of the aircraft and its cargo capacity;
  • days of performing flights;
  • of arrival and departure.

1.2.2.3.3. Application shall be addressed to:

1.2.2.3.4. An aircraft operator that requests for the first time the permission to operate scheduled flights shall submit, together with the application, a legal copy of the following documents:

  • operator's certificate with all appendices;
  • certificate of airworthiness of the aircraft which will operate the flights;
  • insurance policies of mandatory types of the passengers, cargo, luggage and third parties on the ground;
  • other documents on request of Ukraviatrans.

Changes or renewal of expired documents shall be notified to Intergovernmental Agreements and Air Carriage Department of Ukraviatrans soon as possible by submission of the new legal copy of the above mentioned documents.

1.2.2.3.5. The approval of the timetable submitted by the applicant will be notified by Intergovernmental Agreements and Air Carriage Department of Ukraviatrans not later than 15 days before the beginning of planned flights.

Changes to approved timetable have to be co-ordinated with Intergovernmental Agreements and Air Carriage Department of Ukraviatrans not later than 15 days before the day of their implementation.

1.2.2.3.6. The notification of the approval to changes to a timetable will be notified by Intergovernmental Agreements and Air Carriage Department of Ukraviatrans not later than 7 days before the beginning of planned flights.

1.2.2.3.7. To obtain permission for additional flights, the operators shall submit the related application to Intergovernmental Agreements' and Air Carriage Department of Ukraviatrans not later than 3 days before their performing.

1.2.2.3.8. In order to perform the flights, the operator shall submit RPL (lists of RPL), in compliance with the requirements indicated in subsection E 1.10. [0209]

1.2.3. Non-scheduled Flights

1.2.3.1. Procedure to obtain the permission for carrying out non scheduled flights

1.2.3.1.1. To perform a (series of) non-scheduled flight(s) into/from Ukraine for the purpose of taking-on or discharging passengers, cargo or mail, the operator shall submit an application to Flight Coordination Centre (FCC). Service Hours: daily 0700-1900

1.2.3.1.2. The request to perform an international non-scheduled flights shall be submitted not later than:

  • five working days - for commercial flights;
  • one hour - for urgent, sanitary and SAR flights.

1.2.3.1.3. The application must include the following information in the order shown below:

  1. name of operator;
  2. type of aircraft and registration marks;
  3. date and time of arrival at and departure from (aerodrome);
  4. place or places of embarkation or disembarkation abroad, as the case may be, of passengers and/or freight;
  5. purpose of flight and number of passengers and/or nature and amount of freight;
  6. name, address and business of charter, if any.

1.2.3.1.4. Application for special permission must be submitted to the Ministry of Foreign Affairs by diplomatic channel not later than:

  • five working days - for flights with official delegations and for flights of state aircraft;
  • five working days - for flights with military cargo on board;
  • ten working days, in special cases 3 weeks, - for flights with dangerous cargo on board. 1.2.3.2. Documentary Requirements

1.2.3.2.1. The request for non-scheduled flight shall be send to Flight Coordination Centre (FCC) of Ukraviatrans according to the following form:

  1. State of registration of aircraft
  2. Name, address, telephone and fax of the Air company which performs the flight;
  3. Owner of aircraft, operator
  4. Flight number, type of aircraft, maximum take of weight, registration mark (call sign)
  5. Date of departure from the last airport before the entry to the airspace of Ukraine, estimated time of departure
  6. Entry point, estimated time of entry into FIR of Ukraine and route up to the first landing in international airport of Ukraine [0207]
  7. International airport of the first landing in Ukraine and estimated time of arrival
  8. Date of flight, estimated departure/arrival time from/to airport of Ukraine (for flight within Ukraine)
  9. Route within FIR of Ukraine
  10. Date, airport and estimated time of departure from Ukraine
  11. Exit point from the FIR of Ukraine, estimated time of exit from FIR of Ukraine and flight route within FIR of Ukraine [0207]
  12. Airport of first landing at the first airport outside Ukraine and estimated time of arrival
  13. Purpose of flight, number of passengers, passengers' status (if delegation - receiving / sending party, telephone, fax), freight nature and quantity (if charter - freight forwarder/ consignee, telephone, fax), for payment or rent
  14. Insurance policy of obligatory responsibility insurance before third persons*
  15. Armament, photo equipment and other military equipment on board of the aircraft

Planning the series of charter flights with commercial purpose the copy of insurance policy is sent by fax in addition to request.

1.2.4. Transit flights

To satisfy the requirements for authorisation to operate transit flight through the airspace of Ukraine, it is necessary to submit the FPL in accordance with ICAO provisions and procedures to the address given in subsection E 1.10 not later than 1 hour before EOBT or RPL (RPL lists) in compliance with the requirements indicated in subsection E 1.10.2. 1.2.5. Public Health Measures Applied To Aircraft

1.2.5.1. Disinfection of aircraft

1.2.5.1.1. If an aircraft has been pronounced by the public health authorities to be infected with quarantine disease or if it has arrived from a quarantine disease infected area and carries non-hermetically packed fish, crabs, shellfish, fruit or vegetables eatable uncooked, or beverages, the public health authorities shall have the right to prohibit these from being unloaded or to seize for disinfecting or destruction.

1.2.5.1.2. If a crew member or passenger falls ill in flight, or if there are insects, ticks or dead rodents on board the aircraft, the pilot-in-command has to report it to ภาั service 30 minutes before arriving to the airport so that medical aid is rendered in good time and for providing necessary anti-epidemic measures.

After arriving at the airport, the pilot-in-command (or his confidential agent) must complete and submit the health section of the aircraft general declaration to the official of State sanitary-epidemiological service of the airport.

1.2.5.1.3. In case of a forced landing of an aircraft at an airport that does not handle international traffic, the pilot-in-command shall immediately report the forced landing to the local authorities.

1.2.5.1.4. A standard certificate shall be issued to the pilot-in-command of an aircraft, attesting any medico-sanitary measures applied to aircraft.

Note:

  • disinsection carried out before the arrival of aircraft is considered valid if standard "Prescription for deratisation (disinsection) of aircraft" was presented;
  • dirinfection (disinsection, deratization) any aircraft is carried out only without passengers and crew on board.

    1.3 ENTRY, TRANSIT AND DEPARTURE REGULATIONS PASSENGERS AND CREW

    1.3.1. Immigration Requirements, Passport and Visa Regime

    1.3.1.1. The order of entry, exit of foreign citizens to Ukraine and transit across the territory of Ukraine is regulated by the Law of Ukraine "On the Legal Status for Foreigners", Regulation of entry of foreigners, their departure from Ukraine and transit the territory of Ukraine (approved by decree of Cabinet of Ministers of Ukraine on 29 December 1995 No1074), Regulation of grant entrance visa to Ukraine (approved by decree of Cabinet of Ministers of Ukraine on 20 February 1999 No227) and other statutes and international agreements of Ukraine.

    1.3.1.2. Foreigners are permitted to entry into Ukraine provided that they have valid national passports, or substituting documents, and an official invitation from Ukrainian institutions, organisations or residents of Ukraine, which confirm the purpose of foreigners stay in Ukraine. Foreigners also must obtain a visa by a Ukrainian consulate abroad in accordance with the established procedure. Persons, entering Ukraine from the countries with which Ukraine has an entry-exit non-visa regime, must have a valid national passport, or a document substituting it, and an official invitation.

    1.3.1.3. In exceptional cases, foreigners and stateless persons entering Ukraine on official business invitation by State bodies are granted the permission to enter Ukraine in the State international airport Boryspil' for a period of 5 days, according to special writing decision of Ministry of foreign affairs of Ukraine.

    1.3.1.4. Home affairs bodies of Ukraine can solve the question of extension the term of staying in Ukraine of foreigners and stateless persons.

    1.3.1.5. A transit visa is issued only in case a third country visa is available or there is a ticket or other document that confirms the transit nature of the trip, with the allowance for the necessary time to cross the territory of Ukraine. Such a visa does not give the right to stay within Ukraine can not be extended and can not be substituted by another kind of visa. ^

    1.3.1.6. In case of unforeseen stop on the territory of Ukraine subject to the force-major circumstances, provided that the document confirming the stoppage is presented, the foreigner can be given an extended visa or he can be allowed to stay on the territory of Ukraine until the cause of the forced stoppage is eliminated.

    1.3.1.7. Foreign passengers who travel across Ukraine by the direct international air transport communications do not need transit visa.

    1.3.1.8. The procedure of crossing the state border of Ukraine is controlled by the border and customs services.

    1.3.1.9. Foreign citizens violating visa regime can not be allowed to the territory of Ukraine, and in case they are already in Ukraine - they can bear responsibility or can be expelled from Ukraine according to the part IV of the Law of Ukraine "On Legal Status of Foreigners".

    1.3.1.10. In cases, when complying regular flights crew member, that have certificate during embarkation or disembarkation, stays at the airport of arrival or within nearest cities' boundaries, and departs from Ukraine by the same aircraft or by usual regular flight, his certificate accepts instead of passport or visa for temporary being in Ukraine. This regulation is also in force if crew member arrives to Ukraine by another kind of transport to embark on his aircraft.

    1.3.2. Customs Requirements

    1.3.2.1. Baggage, cabin-carried articles, currency and valuables of passengers and crews carried across Ukraine frontier are subject to customs clearance.

    1.3.2.2. Passengers arriving in Ukraine, whose cabin-carried articles and baggage are not exempt from customs examination, shall complete a customs declaration.

    1.3.2.3. Cabin-carried articles and baggage in possession of passengers crossing State border of Ukraine, with the exception of articles prohibited from being taken in or out Ukraine needed for personal consumption, are cleared in order and quantities stipulated by Cabinet of Ministers of Ukraine.

    1.3.2.4. Customs examination of cabin-carried articles and baggage in possession of passengers arriving in Ukraine is carried out in the presence of owner, or his authorised representative, or without them in the cases stipulated by legislation of Ukraine.

    1.3.2.5. While on flight in the airspace of Ukraine, foreign passenger and cargo aircraft are prohibited to carry, as cargo and/or baggage:

    1. military supplies or military equipment;
    2. explosives, toxic agents, radioactive materials, narcotics, as well as articles of contraband;
    3. animals suffering, or suspected of suffering, from infectious disease, as well produce and/or raw material of animal origin and forage that may carry infectious diseases;
    4. quarantinable materials, soil or living plans with soil, from countries whose territory is not free from quarantine pests and diseases, as well as quarantinable materials, soil or living plans with soil infected by quarantine pests and/or diseases.

    1.3.2.6. Sporting guns and ammunition for these, as well as firearms and ammunition for these and hunter's knives, with the consent of the carrier, may be carried as registered baggage, provided these have been placed in baggage-cargo compartments of the aircraft inaccessible to passengers. At that, sporting guns and/or hand firearms shall be unloaded and ammunition for these, appropriately packed separately.

    1.3.2.7. Cameras and cinecameras carried on board an aircraft shall be kept in suitcases. Photographing from an aircraft is prohibited.

    1.3.2.8. Radio sets, including those of small dimensions, may be carried only if packed into baggage. G 1.3.3. Public Health Requirements

    1.3.3.1. Sanitary-quarantine measures are taken in compliance with the Law of Ukraine "On the Provision Sanitary and Epidemic Prosperity of the Population", Regulation of sanitary protection the territory of Ukraine (approved by decree of Cabinet of Ministers of Ukraine from 24 April 1999 No 696) and requirements of the World Health Organisation.

    1.3.3.2. Foreign citizens and citizens of Ukraine may enter the territory of Ukraine from especially dangerous diseases infected countries (localities) provided that they hold the documents stipulated by international agreements and sanitary legislation of Ukraine.

    1.3.3.3. A vaccination certificate is deemed as valid if it is in an international form and within the terms of validity approved by the World Health Organisation, in compliance with requirements of Regulation of sanitary protection the territory of Ukraine.

    Any change to the form of a certificate or blankness of one of its items may make the certificate invalid.

    1.3.3.4. Passengers arriving from quarantine disease infected countries not in possession of a valid international vaccination certificate shall be isolated in a medical institution or medically supervised during incubation.

    1.3.3.5. If a crew member or passenger falls ill in flight, or if there are insects, ticks or dead rodents on the aircraft board, the pilot-in-command has to report it to ภาั service 30 minutes before arriving to the airport so that medical aid is rendered in good time and for providing necessary anti-epidemic measures.

    1.3.3.6. Passengers showing symptoms of acute disease on arriving to airport or while stay in Ukraine shall be forwarded without delay to the nearest medical institution.

    Passengers under medical supervision shall enjoy freedom of movement, but shall notify the public health authorities of their moving on to other places.
